Terms of Service

  Terms and conditions for engaging services of FLASHBACKS PHOTOGRAPHY LLP:

Upon Confirmation of order, FLASHBACKS PHOTOGRAPHY LLP will reserve the date & time agreed upon, and will not make any other reservations for that date & time. For this reason, the Reservation/Confirmation Deposit is non-refundable, even if there in a change in the EVENT date or the EVENT is cancelled for any reason, including Acts of God, fire, strike and/or extreme weather. The Reservation/Confirmation Deposit is applied towards the contracted EVENT photography package and the balance is to be paid in full, one week prior to the EVENT date. Photography services will not commence until the invoice is paid in full.

Two weeks prior to the EVENT, client must finalize with the photographer a schedule of location/s, hours, and (if required) an Event Guide. The client will be responsible for designating an Event Guide, if required.  The main role of the Event Guide is to identify people or objects of whom or which specific photographs are required, as well as to make certain that these people or objects are available when needed.  It is advised that the client provide a list of desired poses, locations, and subjects (family / friends; items; etc.) and share this well in advance with FLASHBACKS PHOTOGRAPHY LLP before the EVENT. 

FLASHBACKS PHOTOGRAPHY LLP will NOT be held responsible for missing out on desired photographs if there is no assistance in identifying or gathering people/items/locations for the desired photographs. The parties agree to positive cooperation & communication for the best possible result within the definition of this assignment/EVENT. FLASHBACKS PHOTOGRAPHY LLP will not be held responsible for key individuals’ failure to be present or to cooperate during the photography sessions, neither for missed images due to details not revealed to FLASHBACKS PHOTOGRAPHY LLP.

It is understood and agreed that the Client will provide the Photographer(s) / Videographer(s) and the rest of the team a meal with assigned seating for events of three hours or longer. If no meal is to be provided, the same has to be informed at the time of the event booking and it is understood the Photographers will leave the event for a half hour to one hour(depending on the location) for a meal break to be taken at Photographer(s) / Videographer(s) discretion. The Photographer(s) / Videographer(s) is not responsible for any photos that may be missed while obtaining a meal.

It is understood & agreed that FLASHBACKS PHOTOGRAPHY LLP will have exclusive right for the photography of the EVENT and will act as the sole EVENT photographer. Since flashes from guests’ cameras may ruin shots taken by FLASHBACKS PHOTOGRAPHY LLP, the client acknowledge that they are responsible for informing/notifying all of their guests that guest photography shall be limited or restricted at the EVENT. Client acknowledge that all work created by FLASHBACKS PHOTOGRAPHY LLP is the intellectual property of FLASHBACKS PHOTOGRAPHY LLP who will retain the copyright to all the photographs taken at the EVENT.

Client agrees not to publish the photographs without permission of FLASHBACKS PHOTOGRAPHY LLP. Client may only post images marked for “web” or “internet” on Facebook, Flickr, Twitter, MySpace or any other similar social networking website. Client may not post full resolution images online. Client also agree not to digitally edit or manipulate the Work for public viewing (wedding message board, social networking public photo galleries  or websites) and incorporate a hyperlink and photo credit of “Photo By: FLASHBACKS PHOTOGRAPHY LLP (http://www.flashbacks.in)” with each image posted.  Client will have unlimited personal use of the photographs at any time for no additional fee.

Client gives permission to FLASHBACKS PHOTOGRAPHY LLP to use the work (photographs) for publication, display, advertising promotion and other uses. FLASHBACKS PHOTOGRAPHY LLP retains the copyrights of the images, for the purpose of fair-use. Fair use for creative professionals is the ability to showcase their work to prospective clients. By fair use, we will probably use the images on our website, social media, blog, internet, magazine or print Ads to promote and showcase our work.

It is understood & agreed that the client will have to pay additional Data holding charges to FLASHBACKS PHOTOGRAPHY LLP if the client delays selection of photographs for preparing the layout of the album there by resulting in a delay for finalising the layout and printing of the album, three months from the date of the event. Three months after the date of the event additional data holding charges will have to be paid by the client to FLASHBACKS PHOTOGRAPHY LLP on a monthly basis. The client agrees to pay additional cost that will be levied if the album printing goes/happens beyond/after 6 months from the date of the event.

While FLASHBACKS PHOTOGRAPHY LLP takes extreme care with respect to exposure, processing and delivery of photographs, in the event that the photos/images get lost, stolen or destroyed, for reasons within or beyond the control of FLASHBACKS PHOTOGRAPHY LLP, liability is limited only to a refund of retainer & payment received. The limit of liability shall not exceed the contract price stated herein.

FLASHBACKS PHOTOGRAPHY LLP will not be held responsible for any ruined photographs due to guests’ (or any other) flashes; or any other spoilt photographs due to any other cause in or outside of FLASHBACKS PHOTOGRAPHY LLP’s control. In the event that FLASHBACKS PHOTOGRAPHY LLP is unable to photograph the EVENT due to: disability, illness, emergency, accident, or Act of God, every effort will be made to find an appropriate photography replacement. If a replacement is unavailable, the payment made to FLASHBACKS PHOTOGRAPHY LLP will be refunded in full, and return of the payment shall be the entire obligation under the agreement/contract. No other damages or guarantees of any kind are recognized or warranted.

In the event that the client reschedule the EVENT and FLASHBACKS PHOTOGRAPHY LLP is able to rebook the original EVENT date, FLASHBACKS PHOTOGRAPHY LLP will amend the EVENT date in the agreement/contract and client will receive credit for all monies paid up to the date client requests the EVENT be rescheduled. In the event that the client reschedules the EVENT and FLASHBACKS PHOTOGRAPHY LLP is NOT able to rebook the original EVENT date, FLASHBACKS PHOTOGRAPHY LLP will amend the EVENT date in the agreement/contract and client will forfeit the Reservation/Confirmation Deposit, but receive credit for all other monies paid up to the date client requests the EVENT be rescheduled. In the event that the client cancels the EVENT outright, Client will forfeit all monies paid up to the date client notifies FLASHBACKS PHOTOGRAPHY LLP that the EVENT is cancelled. Cancellation must be in writing i.e. print or email even if a phone call was made to inform FLASHBACKS PHOTOGRAPHY LLP of the cancellation.

Deliverables: FLASHBACKS PHOTOGRAPHY LLP will try and deliver the photos for viewing and shortlisting purpose around 10-15 days after the event date however ever there can be delays during peak season. The Photographs will be in .JPG/.JPEG format. The photographs for viewing and shortlisting will be of low resolution and will contain a watermark. The Full resolution images without the watermark will be provided on the USB drive along with the video at the time of delivery of the album. Once the final list of photographs for the album are shared by client then work will begin on the layout of the album. Once the album layout is completed it will be shared with the client for review. After the clients approval on the layout is received then and only then will the album be sent for printing.

If the client has also selected video as part of the package then the client is to note that work on the video will begin after the album is sent for printing. If there is a short / Highlight  video included in the package the client is to note that FLASHBACKS PHOTOGRAPHY LLP will decided which audio will be used for the short / Highlight video. FLASHBACKS PHOTOGRAPHY LLP will not use copyright audio / movie sound track  or any commercial audio. FLASHBACKS PHOTOGRAPHY LLP does not make reels. Only a short / Highlight video will be created if it is part of the package and given to the client. All Deliverable have to be picked up from our address/location. If the client does not want to come and collect the final deliverables(USB Drive/Album) from our address/location they can arrange it to be picked up and delivered by Wefast or any other delivery services at their own risk.
